        As with estate planning for any individual or couple, the estate planning for unmarried couples and non-traditional families may be divided into five categories: (i) practices to ensure that property is distributed appropriately; (ii) methods to minimize transfer taxes; (iii) charitable gift planning; (iv) planning for personal needs such as appointment of financial and healthcare decision makers, funeral arrangements, guardianship, and custody of minors; and (v) strategies to minimize conflict. In part one of this outline, Wendy Goffe analyzes the current state of the law regarding same-sex marriage, the ethics of joint representation, and practices to ensure that property is distributed appropriately.

        Asset protection planning is all the rage--but attorneys who are not careful may find their clients--and themselves--facing stiff penal-ties for various types of fraud. In light of all the risks associated with a poorly constructed plan, thorough pre-planning reviews are important. And proper due diligence by the planning attorney will go a long way toward avoiding miscues in the first place and negating any claim of misconduct should a later challenge arise.
