Estate planning for the non-traditional family is only a special application of general estate planning principles and practices. However, unmarried couples often require a more individualized and resourceful approach to their estate planning. In part 2 of this outline, Wendy Goffe focuses on various estate planning tools and the objectives that they accomplish, with an emphasis on their use in connection with planning for the client in a non-traditional family. Updated from the ALi-ABA Course of Study Estate Planning in Depth, cosponsored by Continuing Legal Education of Wisconsin, June 19-24, 2005.
  • Fix-Ups Of Estate Plans After They Have Become Irrevocable (With Sample Language) (Part 1)
        Domingo P. Such, III
        p.45                                                                                        +cite
Estate plans go through numerous iterations before being finalized. Provisions that were appropriate initially may seem less so when the estate "matures." To plan effectively, flexibility is critical. Documents are necessarily complex, and the trend of using long-term trusts is likely to increase the number of trusts that will be scrutinized after they have become irrevocable. This outline explores the different methods currently available for modifying and changing or altering the results of irrevocable trust agreements. Updated from the ALI--ABA Course of Study Estate Planning in Depth, cosponsored by Continuing Legal Education of Wisconsin, June 19-24, 2005.
